Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and Set The World On Fire LLC ("STWOF", "we", "us"). By accessing our website or engaging our services, you agree to these Terms. If you don't agree, please don't use the site or our services.

• Services: the platform systems, marketing automation, SEO infrastructure, and related work we provide.
• Engagement: a specific project governed by an accepted proposal or statement of work ("SOW").
• Client: the business or individual that engages us.
• Deliverables: the systems, configurations, and materials produced under an Engagement.

STWOF is an operator-led studio. We build and operate platform systems, marketing automation, and SEO infrastructure for local service businesses and ecommerce brands. The precise scope, timeline, and outcomes of any work are defined in the applicable proposal or SOW.

We may decline or discontinue work that falls outside our expertise, conflicts with these Terms, or that we reasonably believe is unlawful or harmful.

Work begins once you accept a proposal or SOW. That document controls scope, deliverables, dependencies, and timelines.

• Changes: material changes to scope are handled through a written change request and may affect fees and timing.
• Dependencies: timelines assume timely access, approvals, and information from you.
• Estimates: dates and projected outcomes are good-faith estimates, not guarantees.

Fees, payment schedule, and any retainer or recurring charges are set out in your proposal or SOW. Unless stated otherwise:

• Invoices are due on the terms specified in the SOW.
• Late or missed payments may pause work and recurring services.
• Fees are exclusive of third-party platform, software, and ad-spend costs, which are billed to or paid directly by you.
• Paid fees are non-refundable except where required by law or expressly stated.

To deliver effectively, we rely on you to:

• Provide accurate information and timely approvals.
• Grant and maintain the access we need to the relevant platforms and accounts.
• Hold the rights to any content, assets, or data you provide to us.
• Use the Services and any delivered systems in compliance with applicable law and platform rules.

Our work often relies on third-party platforms and tools (for example, hosting, CRM, automation, analytics, and advertising platforms). Your use of those services is governed by their own terms, and we are not responsible for their availability, changes, or actions. Where a platform changes its rules or pricing, the impact on the work is handled as a change of scope.

The programs

Set The World On Fire LLC operates two messaging programs:

• Customer care: responses to support requests, ticket updates, appointment coordination, and follow-up on an existing enquiry.
• Promotional: special offers, discounts, event promotions, and service announcements.

How you opt in

You provide your mobile number on one of our opt-in surfaces — the chat widget on any page of this site, the contact form at stwof.com/contact, or the appointment booking form — and independently tick one or both consent checkboxes, one per program. Each is a separate and distinct consent, and neither is pre-selected. We never treat consent given on one surface as consent for a program you did not tick.

Consent is not a condition of purchase or of contacting us: you can always reach us by phone or email instead, using the details at stwof.com/contact. Every one of these surfaces, and the opt-in flow behind it, is provided and maintained by LeadConnector, our messaging platform provider. You must be 18 or older to consent to receive messages.

Frequency and cost

Message frequency varies. Message and data rates may apply, based on your plan with your mobile carrier — check with your carrier for details.

Opting out and rejoining

Reply STOP to any message to stop messages from that program. You will receive one confirmation, and then no further messages from it. To rejoin, opt in again through any of the surfaces above — the chat widget on any page of this site, or the contact form at stwof.com/contact.

Carriers and privacy

Carriers are not liable for delayed or undelivered messages. Mobile numbers and SMS consent are handled as described in our Privacy Policy at stwof.com/privacy. No mobile information will be shared with third parties/affiliates for marketing/promotional purposes.

Upon full payment, you own the final Deliverables produced specifically for you under an Engagement, except for any third-party materials and our pre-existing tools, methods, and templates.

We retain ownership of our underlying know-how, frameworks, and reusable components ("Background IP"), and grant you a non-exclusive licence to use them as part of your Deliverables. We may reference the engagement and non-confidential results in our portfolio unless you ask us not to in writing.

Each party will protect the other's confidential information and use it only to perform under the Engagement. This does not apply to information that is public, independently developed, or required to be disclosed by law. These obligations survive termination.

We provide the Services with reasonable skill and care. Except as expressly stated, the website and Services are provided "as is" and "as available", and we disclaim all other warranties to the fullest extent permitted by law, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant specific revenue, ranking, traffic, or business outcomes, which depend on factors outside our control.

To the fullest extent permitted by law, neither party is liable for indirect, incidental, special, or consequential damages, or for lost profits or revenue. Our total liability arising out of or related to an Engagement will not exceed the fees you paid us for that Engagement in the three months before the event giving rise to the claim.

You agree to indemnify and hold STWOF harmless from claims, damages, and expenses arising out of content or materials you provide, your use of the Deliverables, or your breach of these Terms or applicable law.

These Terms apply while you use the site or have an active Engagement. Either party may terminate an Engagement as set out in the SOW, or for material breach that isn't cured within a reasonable notice period.

On termination, you'll pay for work performed and approved costs incurred up to the termination date. Sections that by their nature should survive (IP, confidentiality, disclaimers, and liability) continue to apply.

These Terms are governed by the laws of the State in which STWOF is organised, without regard to conflict-of-laws rules. The courts located there will have exclusive jurisdiction over any dispute, except where applicable law requires otherwise.

We may update these Terms as our practices or the law change. We'll publish the revised Terms on this page, and continued use of the site or Services after changes take effect means you accept the updated Terms.
